Jane Roe: The True Story of the Woman Behind America’s Abortion Precedent

A surprising percentage of younger, modern abortion activists are unaware that Roe v Wade is considered a Supreme Court ruling which established a precedent, not an actual law. Even more still are unaware of the true history behind the court ruling, and the implications that weighed heavily on a single woman.

Norma McCorvey, better known as “Jane Roe”, is a little-known name with a marginalized voice, but her pseudonym is synonymous with abortion access in the United States.

McCorvey was 22 years old when she appeared as a plaintiff in the landmark 1973 case that enshrined a woman’s right to get an abortion. In a reversal that shocked many at the time, McCorvey became a fierce opponent of Roe v Wade, and soon after was all but forgotten by the media.

In 1969 the legendary “Jane Roe” was pregnant for the third time living in the largely conservative south. Her first daughter, whom she birthed as a teenager, was primarily raised by her parents, and the second was put up for adoption.

McCorvey was briefly married at the age of 16 and recalled how her mother beat her when she came out as a lesbian. In addition to her familial crises, McCorvey had a drinking problem and not a penny to her name.

After the birth of her first child, she “quickly realized that she was not fit to be a mother,” nor did she want to be. This is according to author and journalist Joshua Prager, who wrote the book “The Family Roe”.

Faced with the possibility of a third child, McCorvey began to consider abortion. The only problem was that in Texas, the state where she lived at the time, abortion was illegal. In those days, solutions for unwanted pregnancies included secret clinics or traveling to a state that authorized abortion, but at the time McCorvey “simply could not afford it”.

It was at this time that McCorvey was referred to attorneys Sarah Weddington and Linda Coffee. The young lawyers had purportedly been seeking a pregnant plaintiff with whom they could take abortion all the way to the Supreme Court. They found exactly what they were looking for in Norma McCorvey and thus “Jane Roe” was born.

The lawyers achieved their goal, the historic decision set the precedent for women to receive abortions, but the ruling came several years later, meaning that the woman credited with setting the precedent for legal abortion never received her abortion. She gave birth to the third child, colloquially referred to as “Baby Roe”, and gave the child up for adoption.

Although initially not involved in the abortion rights movement, McCorvey came out of the shadows in the late 1980s, doing multiple interviews, participating in demonstrations, and even writing the bestseller “I Am Roe.”

Finally seeking the limelight, she fell somewhat short, however, with the feminist movement little inclined to let her speak. “She was not very educated. And they really marginalized her, they pushed her away,” Prager said, explaining that the rejection came as a slap in the face.

Eventually, in the mid-1990s, after years spent defending access to abortion and having even worked in a clinic herself, McCorvey declared that she was opposed to the procedure. The turnaround came shortly after meeting evangelical pastor Flip Benham.

McCorvey became an active Protestant, growing ever more evangelical, before later converting to Catholicism — strongly defending her new convictions along the way.

 “My lawyers did not tell me that I would later come to deeply regret that I was partially responsible for killing 40 to 50 million human beings,” she said during a 2005 congressional hearing.

In one of the saga’s great ironies, Dallas County prosecutor Henry Wade, who argued in the opposite camp before the Supreme Court, was privately in favor of abortion, according to Prager.

It is difficult to know the true feelings of McCorvey, who died in 2017. Prager said that at the end or her life, she told him she was in favor of abortion through the first trimester.

Her oldest daughter, Melissa Mills, expressed outrage at the Supreme Court’s possible reversal of the Roe decision, revealed in a leaked draft opinion in early May. 

“I think mom would be turning in her grave because she was always pro-woman,” Mills told USA Today. Shelley Thornton, McCorvey’s third child also known as “Baby Roe,” never met her birth mother.

Roe v Wade: Second Night of Civil Unrest See’s Makeshift Flamethrowers and Violent Protests

In the first 48 hours after the Supreme Court’s decision to overturn Roe v Wade, we have seen a variety of reactions from the public. The response has ranged from celebratory to aggressive disapproval.

Virtually all of the violence thus far has come from the left. Ten people were arrested during a violent “protest” at an Oregon pro-life pregnancy center on Friday night. The Eugene Police Department said that the protesters were throwing smoke bombs and trying to fight police outside the Dove Medical Center after 9 p.m.

As per the local police press release: 

“On June 24, Eugene Police began receiving reports of a group publicizing on social media for people to come to a ‘Night of Rage’ in the wake of an opinion by the Supreme Court of the United States, Dobbs v. Jackson (related to Roe v. Wade). The group’s stated meeting point was Dove Medical Center, 487 E. 11th Avenue, for around 10 p.m.. Due to the potential for property damage toward a business located in Eugene, as well as the general safety and security of the other businesses and residents downtown, Eugene Police monitored the situation.”

Things were also getting heated in California when a man was arrested for attempted murder after using a “makeshift flamethrower” (flammable aerosol can and lighter) on a police officer during the Los Angeles “Night of Rage” pro-abortion riot.

The Los Angeles Police Department arrested and charged 30-year-old Michael Ortiz after he attacked the officer, who had to be hospitalized with burn injuries.

The LAPD said in a statement:

 “The vast majority of those involved were peaceful and law-abiding, however, a much smaller group of individuals took to the streets with the intention of creating chaos and destruction…The Los Angeles Police Department has the distinction of facilitating First Amendment Rights for all Angelenos. Equally, the Department will enforce the law when individuals engage in violence. Those who expressed themselves peacefully today are appreciated and recognized by the Los Angeles Police Department.”

Earlier in the evening, around 6 p.m., protesters blocked the northbound side of the in 110 Freeway at Fifth Street. “One man was seen prodding a large rod at a passing car,” the CBS report stated. The busy intersection of Highland Avenue and Hollywood Boulevard in Hollywood was also blocked by the activists.

It is interesting to see this kind of behavior in LA as Governor Gavin Newsom has assured his constituents that abortion will remain legal in California.

Vatican Praises Court Decision on Roe v Wade, No Official Word from Pope Francis

The first 24-hour cycle after the overturn of Roe v Wade saw a spectrum of public responses ranging from jubilation to violence. While many leftist pundits, personalities, and politicians have angrily called for “action”, a department of the Vatican has actually come out in praise of the decision.

Pope Francis himself has yet to release a statement on the US Supreme Court ruling, however, the Pontifical Academy of Life did release an official statement.

As per the Catholic News Agency:

The Pontifical Academy of Life said Friday that the U.S. Supreme Court’s decision to overturn Roe v. Wade “challenges the whole world.”

“The court’s opinion shows how the issue of abortion continues to arouse heated debate. The fact that a large country with a long democratic tradition has changed its position on this issue also challenges the whole world,” the Vatican academy wrote in a statement on June 24.

“The protection and defense of human life is not an issue that can remain confined to the exercise of individual rights, but instead is a matter of broad social significance. After 50 years, it is important to reopen a non-ideological debate on the place that the protection of life has in a civil society to ask ourselves what kind of coexistence and society we want to build,” it said.

The academy’s statement was the first official reaction to the court’s decision issued by an entity linked to the Roman Curia. Pope Francis has condemned abortion using strong language, referring to it as “murder” and on multiple occasions comparing the act of killing an unborn child to hiring a “hitman” to solve a problem.

Archbishop Vincenzo Paglia, the president of the academy, said: “In the face of Western society that is losing its passion for life, this act is a powerful invitation to reflect together on the serious and urgent issue of human generativity and the conditions that make it possible.”

Despite the statement, many Christian conservatives are leery of the Vatican, Pope Francis in particular, as he has met many times with pro-abortion Democrats.

Pope Francis has even called Joe Biden “a good Catholic”.

The lack of a statement from Francis comes amid speculation the Pontiff is poised to step down, ostensibly for health reasons.

Will Roe V Wade Overturn Be the Inciting Incident for an Impending Civil Proxy War?

We’ve officially crossed the Rubicon folks, and the culture war seems to be on the verge of a gruesome crescendo. The Supreme Court has sided with the state of Mississippi and overturned Roe v. Wade. Laws related to abortion will now once again be decided by the states. 

Justice Samuel Alito asserted that Roe was “egregiously wrong” and had been “on a collision course with the Constitution from the day it was decided.”

“Roe was egregiously wrong from the start,” Justice Samuel Alito wrote. “Its reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue, Roe and Casey have enflamed debate and deepened division.”

Mississippi took the case to the Supreme Court, arguing that both Roe and Casey should be overturned. They cited evidence that fetuses can feel pain as early as ten weeks. Oral arguments were made before the court in December 2021.

On May 2, 2022, a draft opinion written by Justice Samuel Alito was leaked to Politico. In the draft, he wrote that “it is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”

To absolutely no one’s surprise, the leak prompted a wave of protests and backlash against conservative justices, including the firebombing of pro-life pregnancy centers and a foiled assassination plot against Justice Brett Kavanaugh.

The response to the leak was bad enough, but now that Roe is officially overturned, there are many indications arising which suggest things could get quite heated in regards to the ongoing culture war.

In the wake of the SCOTUS decision, abortion activists were filmed handing out the home address of Justice Clarence Thomas to fellow protestors outside of the Supreme Court.

The pro-abortion group Ruth Sent Us, who originally doxed the justices and called for protests at their homes, has now called for a protest at the home of Justice Thomas on the evening the opinion was announced.

The focus on Thomas is likely due to a concurring opinion he’d written regarding Roe v. Wade reiterating his view that the due process clause does not protect a right to an abortion. He also stated that the court  “should reconsider” previous rulings from SCOTUS codifying rights to contraception access, same-sex relationships, and same-sex marriage.

Thomas wrote, “…in future cases, we should reconsider all of this Court’s substantive due process precedents, including Griswold, Lawrence, and Obergefell. Because any substantive due process decision is demonstrably erroneous.”

Former President Barack Obama and multiple other Democrat politicians have begun to stoke the flames of civil unrest.

Obama isn’t the only one priming the public for potentially violent action, Democrat Rep. Maxine Waters, the self-appointed ambassador of all black women, responded by telling Americans the Supreme Court has no power to make the decision. “The hell with the Supreme Court! We will defy them!” she threatened, “black women will be out in droves—we will be out by the millions!” She also warned that “black women” will not be intimidated.

Many are claiming that these calls to action are inciting violence in the same fashion it was claimed that Donald Trump incited the Jan. 6th insurrection. The Department of Homeland Security Thursday night warned Catholic churches and pro-life pregnancy centers to be prepared for a “night of rage” by pro-abortion terrorist groups if Roe v Wade gets overturned by the Supreme Court.

Another important aspect of this situation are the ‘trigger bans’ in separate states, meaning abortion immediately becomes illegal once Roe is overturned.

26 states total will likely ban abortion or have a near ban via the Guttmacher Institute:

  1. Alabama—Pre-Roe ban, Near-total ban, State constitution bars protection
  2. Arizona—Pre-Roe ban
  3. Arkansas—Pre-Roe ban, Trigger ban, Near-total ban
  4. Georgia—Six-week ban
  5. Idaho—Trigger ban, Six-week ban
  6. Iowa—Six-week ban
  7. Kentucky—Trigger ban, Six-week ban
  8. Louisiana—Trigger ban, Near-total ban, Six-week ban, State constitution bars protection
  9. Michigan—Pre-Roe ban
  10. Mississippi—Pre-Roe ban, Trigger ban, Six-week ban
  11. Missouri—Trigger ban, Eight-week ban
  12. North Dakota—Trigger ban, Six-week ban
  13. Ohio—Six-week ban
  14. Oklahoma—Pre-Roe ban, Trigger ban (effective November 1, 2021), Near-total ban, Six-week ban
  15. South Carolina—Six-week ban
  16. South Dakota—Trigger ban
  17. Tennessee—Trigger ban, Six-week ban, State constitution bars protection
  18. Texas—Pre-Roe ban, Trigger ban, Six-week ban
  19. Utah—Trigger ban, Near-total ban

An additional four states have political composition, history and other indicators—such as recent actions to limit access to abortion—that show they are likely to ban abortion as soon as possible without federal protections in place.

  1. Florida—In 2021, the state legislature attempted to ban abortion at 20 weeks of pregnancy and an effort to adopt a Texas-style six-week ban was publicized. In April 2022, a 15-week abortion ban was enacted that is scheduled to go into effect in July.
  2. Indiana—In the past decade, the legislature has enacted 55 abortion restrictions and bans, paving the way for a comprehensive ban.
  3. Montana—For the first time in nearly a decade, new abortion restrictions were enacted in 2021, including restrictions on medication abortion and abortion at 20 weeks of pregnancy. (These restrictions currently cannot be enforced due to a court order.)
  4. Nebraska—Although not one of the most prolific states on enacting abortion restrictions, it was the first to adopt a 22-week ban (in 2010), and in 2020, enacted a ban on the standard method for abortion after 15 weeks.

While we hope that no one will be harmed in the fallout, if the riots of 2020 were any indication that the population was capable of keeping protests peaceful then chances are relatively high that we will see some collateral damage. The real question is whether or not this, in addition to other mounting disagreements, is something that can be mitigated without resorting to a “peaceful divorce” or worse yet, a civil war.

FBI Says That it “Will Not Tolerate Violence” Ahead of SCOTUS Decision on Roe v Wade

This week the Federal Bureau of Investigation issued a strong warning that it would work to prosecute any acts of violence that may occur in the wake of the Supreme Court ruling on Roe v Wade, which is set to take place later this month.

File this under “Things nobody believes” alongside the mostly peaceful protests of 2020.

In a joint statement with U.S. Attorney Matthew Graves, Steven M. D’Antuono of the FBI’s Washington Field Office said that the two agencies are:

 “committed to protecting the First Amendment rights of all Americans to express their views peacefully during demonstrations that take place on a regular basis in the nation’s capital, including at the Supreme Court.”

“We also have a responsibility to ensure public safety and the orderly conduct of government business. We will not tolerate violence, destruction, interference with government functions, or trespassing on government property. We are committed to working closely with our local, state, and federal law enforcement partners to stop any individuals who intend to commit violence or criminal activity under the guise of carrying out a demonstration.”

The statement comes as tensions over abortion rights are reaching a boiling point after an unprecedented security breach of the Supreme Court ignited a fiery backlash. 

The Supreme Court is expected to issue a ruling later this month that will overturn the landmark 1973 Roe v. Wade ruling that nationalized abortion rights in the United States.

Activists have in recent weeks been taking protests to the homes of Supreme Court justices; the controversy reached a grim crescendo this week when an individual was reportedly arrested en route to assassinate the Trump-appointed Justice Brett Kavanaugh.
